Victory!

We are thrilled with the Ohio Supreme Court's unanimous ruling (pdf file) on November 20, 2007 that Erie MetroParks must compensate those from whom private property was taken. This is not only good news for many of us, but is a wonderful precedent for property owners everywhere. Even as we celebrate, however, we must not lose sight of the fact that there are those still fighting for their just due in connection with this particular situation. Your support continues to be crucial.

A Gentleman's Agreement

by Erie County Prosecutor Kevin Baxter and Probate Judge Beverly McGookey was implemented between landowners and Erie Metroparks, but Erie Metroparks continues to violate that agreement and stomp on landowners' rights. Meanwhile, Baxter and McGookey look the other way. Read more here.

A January, 2005 Appeals Court Ruling

reversed an Erie County summary judgment in favor of Erie Metroparks. In its ruling, the three judge panel determined that the Erie County Court erred when it failed to consider evidence contradicting its claims to ownership of the disputed property.

Citizens for the Protection of Property Rights

is a neighborhood grassroots organization officially formed in January 1995. We oppose the Erie Metroparks (EMP) Board of Commissioners improper taking of private property and the mishandling of county tax dollars for their Huron River Greenway bike trail project.

We believe

that, as John Adams said in 1787, "The moment the idea is admitted into society that property is not as sacred as the laws of God, and that there is not a force of law and public justice to protect it, anarchy and tyranny commence."
